📑 CaaR – General Platform Terms of Use

Welcome to CaaR.shop, an online automotive marketplace operated by CaaR, a subsidiary of Jawi Auto and Product Bay Group of Companies, with its registered address at Mayfield Boulevard, Southfield PO Box, St Elizabeth, Jamaica, West Indies (“CaaR,” “we,” “our,” or “us”).These Terms of Use (“Terms”) govern your access to and use of the CaaR platform, including all related services, features, and content (the “Services”). By creating an account, listing a vehicle, making an offer, or otherwise using our Services, you agree to be bound by these Terms.If you do not agree, you must not use CaaR.1. Definitions“User” – Any individual or entity accessing or using CaaR.“Buyer” – A User purchasing or seeking to purchase a vehicle.“Seller” – A User listing or selling a vehicle.“Partner” – Third-party service providers such as banks, insurers, inspectors, brokers, and dealerships.“CaaR Credits” – The internal credit system used on the platform.“Vehicle” – Any car, truck, motorcycle, or other motor vehicle listed on CaaR.2. EligibilityYou must be at least 18 years old to use CaaR.You represent that you have the legal authority to buy, sell, or list vehicles.By using CaaR, you warrant that all information provided is true, accurate, and lawful.3. User AccountsUsers must create an account to list or purchase vehicles.You are responsible for safeguarding your login credentials.CaaR may suspend or terminate accounts for violations of these Terms or applicable law.4. Platform RoleMarketplace Only: Except where explicitly stated (e.g., Sell to CaaR), CaaR is not the seller or buyer of vehicles. We act solely as a facilitator between Users and Partners.No Guarantee: CaaR does not guarantee that listings will sell, that Buyers will perform, or that Partners will deliver services without issue.5. Fees & PaymentsCertain services may require fees (e.g., listing fees, CaaR Credits).All fees are stated in Jamaican Dollars (JMD) unless otherwise specified.Fees are non-refundable unless otherwise provided in our Refund Policy.Users are responsible for taxes, duties, and other charges arising from transactions.6. User ResponsibilitiesUsers agree to:Provide accurate vehicle and ownership information.Not list stolen, fraudulent, or illegal vehicles.Not use the platform for unlawful purposes.Respect the rights of other Users and Partners.Comply with all applicable laws of Jamaica and the Caribbean jurisdictions where services are provided.7. Prohibited ConductYou must not:Engage in fraudulent activity.Circumvent CaaR’s payment systems.Post harmful, defamatory, or misleading content.Attempt to hack, disrupt, or misuse the platform.8. Intellectual PropertyAll content on CaaR (logos, designs, software, trademarks) is the property of CaaR.Users may not copy, modify, or exploit CaaR’s intellectual property without prior written consent.9. Limitation of LiabilityCaaR is not responsible for:Vehicle quality, condition, or legality.Partner service performance.Financial losses, indirect damages, or delays.To the maximum extent permitted by law, CaaR’s total liability shall not exceed the fees you paid to us for the specific service.10. IndemnificationYou agree to indemnify and hold harmless CaaR, its directors, officers, employees, and affiliates from claims, damages, or expenses arising from:Your misuse of the platform.Your breach of these Terms.Any transaction conducted through CaaR.11. Dispute ResolutionGoverning Law: These Terms are governed by the laws of Jamaica.Resolution: Disputes should first be resolved by good-faith negotiation. If unresolved, disputes will be referred to binding arbitration in Kingston, Jamaica.12. AmendmentsCaaR reserves the right to update these Terms at any time. Updates will be posted on the website with a new “Last Updated” date. Continued use of the Services constitutes acceptance of the revised Terms.13. SeverabilityIf any provision is held invalid, the remainder of these Terms shall continue in full effect.14. Entire AgreementThese Terms, along with CaaR’s Privacy Policy, Refund & Cancellation Policy, and any service-specific terms (e.g., Sell to CaaR, Partner Terms, Import Terms), constitute the entire agreement between you and CaaR.
Dealership Terms & Conditions

Platform: CaaR.shop (“CaaR”, “we”, “our”, “us”)
Company: Jawi Auto and Product Bay Group of Companies, Mayfield Boulevard, Southfield PO Box, St Elizabeth, Jamaica, West Indies.By registering as a Dealership Partner on CaaR.shop (“Dealer”, “you”, “your”), you agree to the following terms and conditions:1. Service Overview1.1. CaaR provides licensed dealers with access to the CaaR online marketplace to list, promote, and sell vehicles directly to customers.
1.2. Dealers may choose between available subscription plans, which include a 60-day free trial period for new sign-ups.
1.3. Dealers are responsible for managing their listings, responding to leads, and completing transactions with buyers.2. Eligibility & Dealer Verification2.1. To participate, Dealers must be legally registered businesses in Jamaica or the Caribbean with valid dealership licenses.
2.2. CaaR may require supporting documentation (e.g., company registration, TRN, dealer license, proof of address).
2.3. CaaR reserves the right to approve or deny dealership accounts at its sole discretion.3. Subscription Plans & Fees3.1. After the initial 60-day free trial, Dealers must select a paid subscription plan to continue using CaaR services.
3.2. Subscription fees are non-refundable and billed according to the plan selected.
3.3. Dealers may upgrade or downgrade their plan at any time, subject to CaaR’s billing policies.
3.4. Late or failed payments may result in suspension or termination of the Dealer’s account.4. Vehicle Listings4.1. Dealers agree to provide accurate, complete, and truthful information for all vehicles listed, including:Make, model, year, mileage, price, condition, and photographs.
4.2. Misrepresentation of vehicles (e.g., mileage tampering, accident concealment, fraudulent ownership) is strictly prohibited.
4.3. CaaR reserves the right to edit, reject, or remove listings that are misleading, incomplete, or violate laws.5. Sales & Transactions5.1. CaaR is a digital marketplace and is not a party to transactions between Dealers and Buyers.
5.2. Dealers are solely responsible for:Negotiating with buyers.Completing sales contracts.Delivering vehicles.Handling post-sale disputes.
5.3. Dealers must comply with all Jamaican and Caribbean consumer protection and motor vehicle sales laws.6. Prohibited ConductDealers may not:List stolen, illegally imported, or unregistered vehicles.Use the platform for fraudulent, misleading, or unlawful activities.Harass or abuse customers or other partners on the platform.7. Intellectual Property7.1. Dealers grant CaaR a non-exclusive license to use their business name, logo, and vehicle listing content for promotional purposes on the platform and related channels.
7.2. Dealers retain full ownership of their brand and content.8. Liability & Indemnity8.1. CaaR shall not be liable for:Dealer misrepresentations.Customer disputes, fraud, or failed payments.Lost sales or business opportunities.
8.2. Dealers agree to indemnify and hold harmless CaaR from any claims, damages, or disputes arising from their listings or transactions.9. Termination & Suspension9.1. Dealers may cancel their subscription at any time, but fees already paid are non-refundable.
9.2. CaaR reserves the right to suspend or terminate accounts for:Repeated violations of these Terms.Non-payment of fees.Illegal or fraudulent activity.10. Governing Law10.1. These Terms & Conditions are governed by the laws of Jamaica.
10.2. Any disputes shall be resolved in the courts of Jamaica.
CaaR Credits – Terms & Conditions

Company: Jawi Auto and Product Bay Group of Companies, Mayfield Boulevard, Southfield PO Box, St Elizabeth, Jamaica, West Indies.By acquiring, redeeming, or using CaaR Credits (“Credits”), you (“User”, “Customer”) agree to the following terms and conditions:1. Overview1.1. CaaR Credits are a digital reward and payment system available to registered users of CaaR.shop.
1.2. Credits may be earned through platform activities (e.g., selling a vehicle, promotions, referrals) or purchased directly where offered.
1.3. Credits may be redeemed only for eligible services within the CaaR platform.2. Earning Credits2.1. Credits may be issued as part of:Sell to CaaR listings.Promotional campaigns.Partner referrals or affiliate programs.Other activities announced by CaaR.
2.2. CaaR reserves the right to determine the quantity, conditions, and timing of Credits earned.3. Redemption & Usage3.1. Credits may be applied as full or partial payment for eligible services, including but not limited to:Vehicle listing fees.Broker service requests.Importation processing fees.Other approved CaaR platform services.
3.2. Credits have no cash value and cannot be exchanged for money, refunds, or transferred outside of the platform.
3.3. Credits cannot be combined with any unauthorized third-party discounts, vouchers, or promotions.4. Validity & Expiry4.1. Unless otherwise stated, Credits are valid for 12 months from the date of issuance.
4.2. Unused Credits will automatically expire after the validity period.
4.3. Expired Credits cannot be reinstated under any circumstances.5. Non-Transferability5.1. Credits are linked to the registered user’s account.
5.2. Credits cannot be sold, exchanged, or transferred between accounts, except where explicitly authorized by CaaR.6. Refunds & Reversals6.1. Once redeemed, Credits are non-refundable.
6.2. If Credits are issued in error, fraudulently obtained, or used in violation of these Terms, CaaR reserves the right to revoke or adjust balances without notice.7. Abuse & Misuse7.1. Users may not manipulate or misuse the Credits system, including but not limited to:Creating multiple accounts to earn Credits.Fraudulent transactions.Misrepresentation of activities to claim rewards.
7.2. Violations may result in forfeiture of Credits, suspension, or permanent termination of the user’s account.8. Changes to the Program8.1. CaaR reserves the right to modify, suspend, or terminate the Credits program at any time.
8.2. Changes will be communicated through the platform or official channels.9. Liability & Indemnity9.1. CaaR shall not be liable for any loss, theft, or unauthorized use of Credits.
9.2. Users agree to indemnify and hold CaaR harmless from any claims arising from misuse or disputes related to Credits.10. Governing Law10.1. These Terms & Conditions are governed by the laws of Jamaica.
10.2. Any disputes shall be resolved in the courts of Jamaica.
📑 CaaR – Import a Car Terms & Conditions

These Import a Car Terms & Conditions (“Import Terms”) govern the process of sourcing, purchasing, shipping, and delivering vehicles through CaaR.shop (“CaaR,” “we,” or “our”). By submitting an import request or making payment for an imported vehicle, you (“Customer,” “you”) agree to be bound by these Import Terms, as well as CaaR’s General Platform Terms of Use, Privacy Policy, and Refund Policy.1. EligibilityYou must be at least 18 years old.You must be legally permitted to import vehicles into Jamaica or the relevant Caribbean country.You must provide valid identification and, where required, tax and customs clearance information.2. Import Request & DepositCustomers must submit an import request with accurate vehicle specifications (make, model, budget, etc.).A non-refundable deposit of [percentage or flat amount] is required before CaaR begins sourcing a vehicle.Deposits are applied toward the final purchase price.3. Vehicle Sourcing & InspectionCaaR will source vehicles from approved international dealers, auctions, or suppliers.Customers may request independent inspection services (at additional cost).While CaaR will exercise due care in sourcing, no absolute guarantee is provided regarding mileage accuracy, prior accidents, or modifications.4. Purchase & Payment TermsOnce a suitable vehicle is located, CaaR will provide details for Customer approval.Upon acceptance, the Customer must make payment of the balance due within [X business days].Failure to pay may result in forfeiture of the deposit.Payments may be made via bank transfer, escrow, or other approved methods.5. Shipping & DeliveryShipping arrangements will be coordinated by CaaR through approved shipping partners.Estimated delivery timelines are provided but may be subject to delay due to customs, weather, or port conditions.Title to the vehicle transfers to the Customer once full payment is made and shipping is initiated.6. Customs, Duties & FeesAll customs duties, taxes, and port fees are the sole responsibility of the Customer.CaaR is not liable for changes in government regulations or fee schedules.Customers must ensure compliance with import restrictions (e.g., age limits on used vehicles).7. Insurance & RiskRisk of loss passes to the Customer once the vehicle is loaded for shipment.Shipping insurance may be arranged at the Customer’s request and expense.CaaR is not responsible for shipping damage, loss, or delays caused by third-party carriers.8. Cancellations & RefundsDeposits are non-refundable once a sourcing process begins.If CaaR fails to source a vehicle within [60 days], deposits may be refunded less administrative fees.Once a purchase is confirmed with an overseas supplier, no cancellations or refunds will be granted.9. Warranties & DisclaimersImported vehicles are sold “as is”, unless otherwise stated in writing.CaaR makes no warranty regarding the condition, mileage, or performance of imported vehicles.Customers are encouraged to request third-party inspections for added assurance.10. Limitation of LiabilityCaaR shall not be liable for:Delays in shipping, customs clearance, or delivery.Losses arising from inaccurate information provided by the Customer.Damages beyond the value of the fees paid directly to CaaR.11. IndemnificationYou agree to indemnify and hold harmless CaaR from claims, penalties, or liabilities arising from:Non-compliance with customs regulations.False or misleading information provided by you.Third-party disputes related to importation.12. Dispute ResolutionDisputes under these Import Terms shall be handled under the General Platform Terms of Use, Section 11 (Dispute Resolution).13. AmendmentsCaaR may amend these Import Terms from time to time. Updates will be posted on the website with a revised “Last Updated” date. Continued use of Import Services constitutes acceptance of the updated Terms.
📑 CaaR – Third-Party Partner Service Terms

These Third-Party Partner Service Terms (“Partner Terms”) govern your participation as a partner on CaaR.shop, operated by CaaR, a subsidiary of Jawi Auto and Product Bay Group of Companies, with its registered address at Mayfield Boulevard, Southfield PO Box, St Elizabeth, Jamaica, West Indies (“CaaR,” “we,” or “our”).By registering as a Partner, accessing the Partner Portal, or offering services through CaaR, you agree to be bound by these Partner Terms, the General Platform Terms of Use, Privacy Policy, and any applicable supplemental agreements.1. Definitions“Partner” – A third-party service provider offering financial, inspection, brokerage, shipping, or dealership services via CaaR.“Customer” – A User who engages a Partner through the CaaR platform.“Services” – Any Partner-provided service offered to Customers.“Portal” – The Partner dashboard or portal provided by CaaR for managing leads, service requests, and communications.2. Partner Eligibility & CompliancePartners must hold valid licenses, registrations, and permits required under Jamaican law (and applicable Caribbean laws).Partners must comply with all consumer protection, financial services, data privacy, and automotive regulations relevant to their services.Partners are responsible for ensuring that all employees, agents, or representatives using the Portal are authorized and trained.3. Relationship with CaaRCaaR acts solely as a facilitator and marketing platform.No joint venture, employment, or agency relationship is created between CaaR and Partners.Partners operate as independent contractors and are solely responsible for their services.4. Partner ResponsibilitiesPartners agree to:Provide accurate, transparent, and lawful information to Customers.Deliver services with reasonable skill, quality, and care.Promptly respond to Customer requests and communications.Maintain confidentiality of Customer data in accordance with the Privacy Policy.Avoid misleading claims, deceptive practices, or misrepresentation of services.5. Fees & CommissionsCaaR may charge listing fees, referral fees, or commissions for Partner services.Fee structures will be outlined in the Partner Portal or specific agreements.Fees are non-refundable unless expressly stated.Partners are responsible for applicable taxes and regulatory charges.6. Use of CaaR Platform & BrandingPartners may only use CaaR branding, trademarks, and marketing materials with CaaR’s prior written consent.Unauthorized use, modification, or misrepresentation of CaaR’s branding is strictly prohibited.CaaR reserves the right to remove or suspend Partner listings at its discretion.7. Liability & DisclaimerCaaR does not warrant or guarantee the quality, outcome, or legality of Partner services.Partners are solely responsible for all claims, disputes, or liabilities arising from their services.To the maximum extent permitted by law, CaaR shall not be liable for any indirect, incidental, or consequential damages resulting from Partner activities.8. IndemnificationPartners agree to indemnify, defend, and hold harmless CaaR, its affiliates, directors, and employees from any claims, losses, damages, or expenses arising out of:Partner’s breach of these Terms.Partner’s violation of laws or regulations.Customer disputes relating to Partner services.9. TerminationEither party may terminate the partnership with 30 days’ written notice.CaaR may suspend or terminate a Partner immediately in cases of fraud, non-compliance, or misconduct.Upon termination, Partner access to the Portal will be revoked and outstanding fees will remain payable.10. Data ProtectionPartners must handle Customer data in compliance with the Privacy Policy and applicable data protection laws.Data may only be used for purposes directly related to fulfilling Customer requests.Partners must not sell, share, or misuse Customer data obtained through CaaR.11. Dispute ResolutionDisputes under these Partner Terms shall be handled under the General Platform Terms of Use, Section 11 (Dispute Resolution).12. AmendmentsCaaR reserves the right to amend these Partner Terms from time to time. Updates will be posted on the website with a revised “Last Updated” date. Continued participation as a Partner constitutes acceptance of the updated Terms.
📑 Sell to CaaR – Terms & Conditions

These Sell to CaaR Terms & Conditions (“Sell to CaaR Terms”) govern your participation in the Sell to CaaR program offered on CaaR.shop (“CaaR,” “we,” or “our”). By submitting your vehicle for consideration under this program, you agree to be bound by these Sell to CaaR Terms, as well as CaaR’s General Platform Terms of Use, Privacy Policy, and Refund Policy.1. EligibilityYou must be the legal owner of the vehicle, with full authority to transfer ownership.You must be at least 18 years old.You must provide valid government-issued identification and proof of ownership (e.g., title, registration).2. Submission Fee & DurationA non-refundable submission fee of JMD $1,000 is required to list your vehicle under the Sell to CaaR program.The listing will remain active for seven (7) days.After the 7-day period, you will automatically be credited with five (5) CaaR Credits, regardless of whether CaaR purchases your vehicle.3. Vehicle Submission RequirementsYou must submit accurate information regarding the vehicle, including:Make, model, year, mileage, VIN/chassis number.Condition (with supporting photos).Any damage, liens, or encumbrances.All information must be true and complete. Submission of false or misleading details may result in rejection and account suspension.4. Evaluation ProcessCaaR reserves the right to evaluate, inspect, or verify the submitted vehicle before making a purchase decision.CaaR is not obligated to purchase every vehicle submitted.Decisions on whether to purchase a vehicle are final and at CaaR’s sole discretion.5. Offers & PayoutsIf CaaR chooses to purchase your vehicle, you will receive a written offer.If you accept, ownership must be transferred free of liens or encumbrances before payout.Payment will be made within [5–10 business days] of completing the ownership transfer and verification process.Payments may be made via bank transfer, certified cheque, or other agreed method.6. Ownership TransferSellers must sign over the vehicle title and provide all supporting documents (keys, registration, service records, etc.).CaaR assumes no responsibility for unresolved liens, unpaid loans, or fines attached to the vehicle.By transferring ownership, you warrant that the vehicle is free of undisclosed legal claims.7. No Guarantee of SalePayment is not guaranteed unless CaaR formally accepts and completes the purchase process.The submission fee does not secure a sale, only consideration.8. Refunds & CaaR CreditsSubmission fees are non-refundable.Sellers receive 5 CaaR Credits after the 7-day listing period, regardless of sale outcome.Credits may be used toward future services within the CaaR platform, subject to the Credit Policy.9. Limitation of LiabilityCaaR is not responsible for:Vehicles not purchased after submission.Market fluctuations affecting offers.Any costs incurred by you in preparing or submitting your vehicle.Maximum liability of CaaR is limited to the submission fee paid.10. IndemnificationYou agree to indemnify and hold harmless CaaR and its affiliates against claims, damages, or losses arising from:Misrepresentation of your vehicle.Failure to disclose liens, encumbrances, or defects.Disputes relating to ownership or transfer.11. Dispute ResolutionDisputes under these Sell to CaaR Terms shall be handled under the General Platform Terms of Use, Section 11 (Dispute Resolution).12. AmendmentsCaaR may update these Sell to CaaR Terms from time to time. Updates will be posted on the website with a revised “Last Updated” date. Continued participation constitutes acceptance of the updated Terms.
